Terms of service
The service
Turbo Monkey is a Chrome extension and hosted service that adds dashboards, chat and tools to the Shopmonkey web application for your shop. It is an independent product. Shopmonkey is a separate company with its own terms, and your use of Shopmonkey remains governed by them.
Your account
You must have a Shopmonkey account to use the service. You are responsible for who in your shop has access to the computers the extension is installed on, and for keeping your Shopmonkey login secure. Accounts, sign-in and billing through this website are not yet available; these terms will be updated before they are.
Subscription and billing
The service is sold as a monthly subscription per shop, billed in advance each month, starting when your shop is onboarded. An owner with more than one location is billed per location. There is no free trial.
It's month to month, cancel whenever, and if the first thirty days don't pay for themselves we refund the first month. Cancellation takes effect at the end of the current billing month, and you keep access until then. To take the refund, tell us within thirty days of your shop being onboarded. Prices are shown on the pricing page and may change with notice before your next billing month.
Acceptable use
Use the service only for your own shop or shops. Do not resell it, share it with shops that are not subscribed, attempt to extract our server-side code or data, or use it in a way that violates Shopmonkey's terms or any law. We may suspend an account that does.
Data
Your shop's data remains yours. We use it only to provide the service, as described in the privacy policy. You are responsible for having the right to let us process the customer information your shop keeps in Shopmonkey.
Availability and changes
We aim to keep the service available and will tell you about planned downtime where we can. Shopmonkey changes its application from time to time, and features that attach to its pages may stop working until we update them. Where a dashboard cannot get a number, it shows that the number is unavailable rather than guessing. We may add, change or retire features; if we retire something you rely on, you may cancel.
Warranty and liability
The service is provided as is. The figures it shows are derived from your Shopmonkey data and the settings you provide, and are for running your shop, not for accounting, tax or legal purposes. To the extent the law allows, our total liability to you for any claim is limited to the subscription fees you paid in the three months before the claim arose.
Governing law
These terms are governed by the laws of the state in which the operating company is organised, and disputes will be heard in the courts of that state.
